فروری 2023 کو، آرٹیکل 184 (3) کے تحت چیف جسٹس آف پاکستان عمر عطا

بندیال نے پنجاب اور کے پی کے میں ضمنی انتخابات میں تاخیر کے معاملے پر از خود نوٹس لیا . جب صدر عارف علوی نے دونوں صوبوں میں انتخابات کی تاریخ کا اعلان کیا تھا، تاکہ انتخابات کی تاریخ کے حوالے سے غیر یقینی صورتحال کو واضح کیا جا سکے۔ 
پس منظر 
 
یہ کہانی چیئرمین پاکستان تحریک انصاف عمران خان کی ہدایت پر پنجاب اسمبلی (14 جنوری) اور کے پی کے اسمبلی (18 جنوری) کی تحلیل سے شروع ہوئی۔ 
 
پنجاب اسمبلی کی تحلیل کے بعد (آرٹیکل 112 کے تحت) نگراں حکومت کی تشکیل مسلم لیگ ن اور پی ٹی آئی کے درمیان ایک متنازعہ معاملہ بن گیا جسے الیکشن کمیشن آف پاکستان نے حل کر دیا۔ 
 
اگلا مرحلہ انتخابات کی تاریخ کا اعلان کرنا ہے جو نگران حکومت، گورنر اور الیکشن کمیشن آف پاکستان کی ذمہ داری ہے۔ 
 
آرٹیکل 224 (ضمنی انتخابات کا وقت)

اس آرٹیکل کے مطابق اگر صوبائی اسمبلی اپنی مدت پوری کرے گی تو الیکشن 60 روز کے اندر منعقد کیے جائیں گے لیکن اگر آرٹیکل 112 کے تحت اسمبلی تحلیل ہو جائے تو انتخابات 90 دن کے اندر کرائے جائیں گے۔ 

 
گورنر کی طرف سے الیکشن کی تاریخ کا اعلان کرنے میں تاخیر کی وجہ سے،لاہور ہائی کورٹ نے دونوں فریقین کی سماعت کی اور الیکشن کمیشن سے مشاورت کرنے اور انتخابات میں تاخیر سے بچنے کی ہدایت کی۔ 
 
صدر نے انتخابات کی تاریخ کا اعلان کردیا؛ قانونی ہے یا نہیں؟ 
 

فروری 2023 کو صدر عارف علوی نے اپنے آئینی اختیار کو استعمال کرتے ہوئے ضمنی انتخابات 9 اپریل کو کرانے کا اعلان کیا [الیکشن ایکٹ آف 2017 سیکشن 57(1) میں کہا گیا کہ صدر کو یہ اختیار حاصل ہے کہ وہ الیکشن کمیشن سے مشاورت کرنے کے بعد عام انتخابات کی تاریخ کا اعلان کر سکتے ہیں]۔ 
 
یہاں دو امکانات ہیں؛ 
 
پہلا؛ صدر قومی اسمبلی کے عام انتخابات کا اعلان کر سکتے ہیں لیکن موجودہ معاملہ صوبائی اسمبلی کے ضمنی انتخاب کا ہے۔ 
 
دوسرا؛ صدر کا الیکشن کمیشن کے ساتھ مشاورت کرنا ضروری ہے لیکن موجودہ صورت میں ایسا نہیں ہوا۔ 
 چیف جسٹس کا از خود نوٹس 
 
اس صورتحال میں جب ملک معاشی بحران اور سیاسی عدم استحکام کی لپیٹ میں ہے تو چیف جسٹس نے ضمنی انتخابات میں تاخیر کے معاملے ازخود نوٹس لیا۔ 

 

ازخود نوٹس کی سماعت کے لیے نو رکنی بینچ تشکیل دیا گیا. سماعت کے دوران ایک اہم سوال کیا گیا

کہ کیا آئین کے مطابق صوبائی اسمبلیاں تحلیل کی گئیں؟ 

 
: چیف جسٹس نےازخود نوٹس کی دوران سماعت میں ریمارکس دیئے کہ 

عام حالات میں شہری عدالت کا دروازہ کھٹکھٹاتے ہیں لیکن آج آئین نےعدالت کا دروازہ کھٹکھٹایا ہے 
پوری قوم کی نظریں 27 فروری کو سپریم کورٹ کی سماعت پر لگی ہوئی ہیں کہ؛ کیا عدالت الیکشن کی تاریخ کے حوالے سے آئین کی تشریح کرنے میں کامیاب ہوگی؟

During a Television Talk, the expel PM Imran Khan announced “Jail Bahro Tehreek” and order his party worker to wait for the date and get ready for this movement in order to inflict pressure to the federal government. 

Imran Khan called for this movement after the sedition cases and arrest of his senior party worker I.e.  Fawad Chaudhry and Shadana Jahanzeb. 

Jail Bahro Tehreek: 

This movement is known as the “Jail Bahro Andolan”. It is a method of protest to exert pressure on the authority. In this movement the protesters voluntary fill the jails. This movement start by the party leader who enter into the jail first. 

In India it a peaceful way of protest. Anne Hazara (Social Activist in India) exercised this movement during Jan Lokpal Bill 2011 and became successful in making his demand. 

Origin: 

The origin of Jail Bahro Tehreek can be traced backed to the era Mahatma Gandhi (sent to jail for 11 times) who practiced this movement during the freedom movement of Indian-Subcontinent. 

Imran Khan is following Gandhi or Jinnah? 

The PTI’s leader Imran khan who always talk about democracy needs to work constitutionally. He can give a tough time to existing coalition government in a Parliament as a strong opposition. However, he first resigned from National Assembly and then dissolved the Provincial Assemblies of KPK and Punjab. Now he is trying to fulfill his demands by this movement. 

Imran Khan who claimed to be a true Follower of Quaid-E-Azam, instead of emulating the principles of Jinnah he tries to follow the principle of Gandhi (Non-cooperation movement with government). 

Chief of PILDAT (Pakistan Institutions of Legislative Development and Transparency), Ahmad Bilal Mehboob said that his decisions might be helpful if he wanted to remembered himself as an agitator but if he wanted to remembered as positive then he should have to act like a Stateman. 

Will this movement be able to pressurized the authority? 

If the protestors fill the jail countrywide then there comes a stage when the government make a mistake and this point will be the success of the protestors. 

Some experts have the opinion that this step of Imran khan will able him to fulfill his demand of election. 

In LUMS (Lahore University of Management Sciences), Professor of Political Science Dr. Rasul Bakhsh and Pakistani Journalist Saleem Safi, pursed the step of Imran Khan a “Very effective Strategy”. 

Conclusion: 

Some experts predicted the failure of this movement. Suppose if this strategy of filling the jail to full the demands will be successful. Now here a question arrive, Is Imran Khan ready to go in jail first?
